He's Home

It's not the very best outcome, but it's probably the second best. The ASA declined to take the case at this time, so the investigation is still ongoing with DCFS but there was no custody hearing. We picked up Landon from the shelter and got home about 30 min. ago. We're still under a voluntary Safety Plan and we must have an approved person supervising us at all times with Landon, but we're together.

We'll start fighting the rest of this tomorrow. Right now it's time for a bath, a meal, and a lot of family cuddling.

I AM SO EXCITED!!!! YAY!!!! I have been checking your blog ALL DAY on my cell phone (my school that i work at blocks all blogger sites so i had to bust out the web on the cell phone!) and have been praying all day! The kids in my classes wanted to know what was wrong with me because I was so down and quiet today....now I can go back to annoying them! Give Landon a big ole kiss and love on him all day!!!!

When you're rested, I hope you will post some more about what this means legally, for all the law students in the audience. Did the ASA decline to take the case because they thought there was no probable cause? Does that mean Dr. K was way out of line in recommending all this in the first place?

Heard the news earlier from Citations and I actually did a little dance at my desk. The attorneys literally came out of their offices to see why their normally sedate assistant was whooping it up. ;) Hug that precious baby tight!

How long does the "safety plan" last, and how long does DCFS have to put up or shut up? If the ASA didn't take the case now, I doubt that will change in the future. DCFS can investigate all they want to, but all they will have is what they went in with today: nothing.

I'm so happy for you guys! BTW, asked my ped about TBBD, he had never heard of it, but concurred that there were definitely other reasons than abuse for rib fractures. He said your ped should have been contacted ASAP to attest to your parenting and character. Too bad DCFS and the other doctors dropped the ball, there. I hope this whole ordeal is a distant memory very soon. I'm sure we'll all be cuddling our kids a little extra, today. Good luck!

Just some thoughts. After all of this you have more knowledge of the medical issues which contributed to Landon's discomfort. It is so sad we live in a world were DCFS workers are overcome with so many real child abuse cases and basically have to treat all as suspects for the safety of the children. Another random thought regarding childcare. The provider might be wonderful but when her/his back is turned to clean a bottle, etc and it is amazing how sneaky some kids can hit another with a toy, etc. The provider can turn around to tend to the crying baby and the little attacker is off playing somewhere else leaving the baby who is too young to verbalize what happened. Oh joy, the trials of parenthood. Welcome your journey has just begun.

It looks to me like you are seeing the possibility of "overcoming evil with good" in the dimension of the solidarity of your wider human family as witnessed in the response to your heartache. No matter what, don't give up!
